An ambush would have been a better way to get Hermione. As soon as she felt threatened, (especially after the attacks in fifth, sixth, and seventh years) she would have a wand in hand and be on guard.

Pansy and Millicent are no where near as scary as Death Eaters with free reign. Also they are slytherins. This means they should have enough cunning to know that the crucatius curse inside Hogwarts would be noted, Hermione is not to be triffled with, and be laying low after the Voldemort uprising fiasco.
