Honestly, I like Asuka/Shinji, and this one is a nice, not really OoC, way of them getting together.

Amusing, entertaining, well written and thought out, and strangely enough fairly in-character.
Well, that managed to be not overly fluffy without simultaneously depressing me for days to come, so kudos to you.

One mistake I feel I have to correct: You meant 'pleading the fifth' as in fifth amendment. The second amendment is the right to bear arms. You could leave it as an intentional mistake, as it is a rather funny pun in my opinion; "No wonder they were so dead set about keeping that second amendment of theirs, it was a bloody useful thing in a pinch."
