On April 27th, FanFiction.Net updated their front web page to say:

"In
addition, FanFiction.Net would like to address a growing
problem. For whatever reason, some writers feel it's okay to
cut-n-paste musical lyrics they have not written into their
fiction. If you did not write it, do not post it. This has
always been our policy. Please remove these entries immiediately to
avoid account closure."

Now, maybe I'm just strange, but I don't
go to FanFiction.Net's front page daily to see what riviting news the
admins are positng there, especally since most of it seems to have been
about bugs they have finally got around to fixing. Anyway, on May 4th, the following arrived from bot@fanfiction.net:

Summary: etc, not included

Main reason for removal: "Not the property of the uploading writer"

the above story has been removed because it violated the guideline detailed on the upload page.

This
infraction has been recorded and once you reach a certain limit, your
account will be automatically banned. Morever, as a result of
this infraction, you will not have upload access for a period of time.

FanFiction.Net has a set of guidelines for the uploading of stories and chapters.

Now, I went out and looked at the guidelines and upload page, and didn't see anything that would
clearly support their removal notice per the 3/27/2005 version of the
guidelines. I didn't see any guidelines on the upload page.
The only thing that I saw that came close was in the terms of service,
which says you must have a legal right to what you upload. To my
best knowlege and belief (and reflected by the many lyrics search
sites, some of which address this detail in to the degree that it could
have only been done by a lawyer paid by the word) all lyrics used in
Reign O'er Me were in full compliance with the fair use doctrine AND
credited to the group performing them, namely The Who.

I wrote
FanFiction.Net and asked them to explain their action, their policy,
and why my use under the Fair Use doctrine was objectionable. To
date, they have not replied.

My initial reaction was to say to
hell with FanFiction.net, since this is merely the latest of a number
of what I consider to be silly decisions and lousy customer service on
their part (for example, I wouldn't be nearly annoyed if I had received
an email that said "Hey, we've decided to disallow any fair use of
other material, remove this from your story or we'll remove it for
you". But no, they chose another customer service model
instead. In any case, given that there are a lot of people on my
watchlist here, I'll be republishing an edited version that complies
with my best guess as to what their guidelines are. I encourage
